Each order is considered as acceptance by the buyer of our general terms and conditions. These terms and conditions form an integral part of the agreement as described below.

By placing an order, the user declares that he or she is eighteen years or older.

We cannot guarantee that the content is free of mistakes, omissions, or typographical errors, or that the information is always up-to-date.

We reserve the right to modify, change, or remove content at any time without prior notice. If a significant change is made to a product during the ordering process, the buyer will be notified immediately. Content is non-binding and intended for informational purposes only.

The content of this website, including images, logos, drawings, photos, data, product names, texts, etc., is protected by worldwide copyright and other proprietary rights and treaty provisions.

All our quotations are non-binding. We are only bound by an order once we have confirmed it in writing or started execution. Product and pricing information, as well as detailed order information, are provided subject to change and correction.

All product and service prices on this website are in Euros and include VAT (6% or 21%). Shipping costs, taxes, and other charges are not included unless stated otherwise or explicitly agreed in writing.

Shipping costs are added after placing an order, and payment can be made using the options indicated during the ordering process. The date on which the payment is received in Vandekerckhove's Coffee Roastery’s bank account is considered the payment date.

All offers by Vandekerckhove's Coffee Roastery are non-binding. Vandekerckhove's Coffee Roastery may change prices at any time without prior notice. Billing is based on the amount in the order confirmation. If product and service prices increase between the order date and fulfillment, the buyer may cancel the order or agreement within 14 days of notification of the price increase.

Products are only delivered to countries for which the website allows delivery. Delivery will, to the extent possible, occur within the timeframe indicated in the individual order confirmation. Incorrectly provided delivery addresses are the buyer’s responsibility and may incur additional costs. Unless otherwise stated, our prices do not include transport and delivery to the buyer. Transport and delivery costs are stated separately. Delivery times are indicative and non-binding. No delay in delivery can justify cancellation of the purchase or payment of damages to the buyer, except in cases of intentional delay. We reserve the right to make partial deliveries. In the event of non-delivery, amounts paid by the buyer will be refunded without interest or other compensation.

The buyer is responsible for all additional taxes and duties. Vandekerckhove's Coffee Roastery cannot be held responsible for fees charged by third parties.

We are not liable for delays or non-performance of our obligations due to events beyond our control, including production interruptions, supply difficulties or shortages of raw materials, labor, energy, or transport, transport delays, strikes, lockouts, work stoppages, or other collective labor disputes affecting us or our suppliers, even if such events were foreseeable.

Our warranty is limited to the warranty for hidden defects and consumer purchase warranty, both provided in the Civil Code. We are only liable for damage resulting from intent or gross negligence. We are not liable for general or special indirect damages of any kind suffered by the buyer.

To be valid, complaints must be received by us: (a) for non-conforming delivery, within eight (8) days of delivery, and (b) for hidden defects, within eight (8) days of discovery of the defect or when it could reasonably have been discovered. Receipt of the goods by the buyer covers any defects or non-conformity that could have been detected at that time.

For distance selling to consumers under the scope of the Belgian Law of 14 July 1991, the consumer has the right to notify the seller that they withdraw from the purchase, without penalty and without giving a reason, within 7 days following the day after delivery. If the consumer exercises this right, the goods must be returned in original condition and packaging at their own risk and cost to Vandekerckhove's Coffee Roastery, Brabantdam 55, 9000 Ghent (Belgium). Products can only be returned with Vandekerckhove's Coffee Roastery’s approval and must be accompanied by the invoice. The product will then be replaced or refunded (see 'returns'), depending on product availability and the customer’s preference.

When purchasing products or services, the buyer explicitly agrees that their personal data may be used for administrative purposes, such as creating and maintaining a customer database, tracking orders, shipments, and invoices, and verifying solvency. Personal data will only be used for promotional purposes, personalized advertising, and/or other (re)marketing purposes.

Vandekerckhove's Coffee Roastery will never share this personal information with third parties, unless explicitly requested by judicial authorities or required by law. The buyer has the right at any time to access or modify their personal information and to object free of charge to the processing of their personal data for direct marketing purposes. For more information, the buyer can contact the Privacy Commission in Brussels.

Within the scope of their relationship, the parties accept electronic evidence.

If any provision of these terms is declared void, this shall not affect the validity of the remaining provisions. Vandekerckhove's Coffee Roastery reserves the right to modify the content of these General Terms. Changes will be announced on the website.

All agreements concluded with the seller are governed by Belgian law. Belgian courts have exclusive jurisdiction.
